Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the FitPilot application and website (the “Service”) provided by [Company legal name] (“FitPilot,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.
2. The Service
FitPilot provides AI-assisted fitness coaching, including generated workout and nutrition plans, session adjustments, tracking, and analytics. We may add, modify, or discontinue features at any time. Plans and recommendations are generated in part by automated systems and are provided for general informational and fitness purposes only.
3. Your Account
You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
4. Subscriptions, Free Trials, and Billing
- Paid plans (“Pro”) are billed through the Apple App Store or Google Play in accordance with their terms.
- Free trials automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends.
- Subscriptions renew automatically for the same period until cancelled. You can manage or cancel renewal in your app store account settings.
- Prices may change; we will give notice as required, and changes apply to subsequent billing periods.
5. Cancellations and Refunds
You may cancel at any time; access continues until the end of the current billing period. Except where required by law, payments are non-refundable and are handled by the applicable app store under its refund policy.
6. Health Disclaimer and Assumption of Risk
FitPilot is not a medical device and does not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any exercise or nutrition program, especially if you are pregnant, have a medical condition, or take medication. Physical activity carries inherent risks; you voluntarily assume those risks and are solely responsible for exercising safely and within your limits. Stop and seek medical attention if you experience pain, dizziness, or discomfort.
7. AI-Generated Content
Plans, adjustments, and coaching responses are produced by automated systems and may contain errors or be unsuitable for your circumstances. Use judgment, and do not rely on AI output as professional, medical, or nutritional advice. You are responsible for decisions you make based on the Service.
8. Acceptable Use
You agree not to:
- Violate any law or the rights of others.
- Reverse engineer, scrape, or attempt to extract source code or models from the Service except as permitted by law.
- Disrupt, overload, or circumvent security or rate limits of the Service.
- Use the Service to build a competing product or to train machine-learning models.
- Resell, sublicense, or commercially exploit the Service without our consent.
9. User Content
You retain ownership of the data and content you submit. You grant us a limited, worldwide license to host, process, and use it solely to operate and improve the Service and to provide it to you. You are responsible for your content and represent that you have the rights to submit it.
10. Intellectual Property
The Service, including software, design, text, and the FitPilot name and logo, is owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
11. Third-Party Services and App Stores
The Service relies on third-party platforms (including Apple, Google, and cloud and AI providers). Your use of those platforms is subject to their terms. We are not responsible for third-party services and do not endorse third-party content they provide.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be achieved.
13. Limitation of Liability
To the maximum extent permitted by law, FitPilot and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or for personal injury arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.
14. Indemnification
You agree to indemnify and hold FitPilot harmless from claims, damages, and expenses arising out of your use of the Service or violation of these Terms.
15. Termination
We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.
16. Governing Law and Disputes
These Terms are governed by the laws of [jurisdiction], without regard to conflict-of-laws rules. Disputes will be resolved in the courts of [jurisdiction], unless mandatory consumer protection laws in your country of residence provide otherwise.
